Lawyers for Boston Marathon Bombing suspect Dzhokhar Tsarnaev, have asked prosecutors to disclose any evidence from a separate murder case and for the judge to delay their client’s upcoming trial.
USA Today reported that Tsarnaev’s defense attorney William Fick, is seeking evidence from a 2011 triple murder in which the suspect’s deceased older brother was allegedly involved in.
The Associated Press noted that Tsarnaev's lawyers said prosecutors have yet to disclose the evidence about his elder sibling’s supposed participation in the killings.
"If Tamerlan Tsarnaev did participate in a brutal triple murder in Waltham, that would be a very important thing for the jury to know and weigh," said Fick.
In addition to asking that the evidence be turned over, defense lawyers are also requesting that the trial, set for to begin Jan. 5, be delayed.
Judge George O'Toole has not ruled on the matter yet.
Tsarnaev is the sole living suspect accused of detonating pressure cookers near the finish line of the 2013 Boston Marathon where three people were killed and hundreds were injured. His older brother, also suspected of planting and detonating the explosives, was killed in a shootout with police.
Tsarnaev has plead not guilty. If convicted he faces the death penalty.
