Martha Stewart Sued by Hand Model

A hand model is suing Martha Stewart Living over hand injury.
Kmart Corp. and Martha Stewart Living Omnimedia are being sued by a man who claims a Martha Stewart Everyday lounge chair collapsed on his hand and cut off his fingertip, reported TMZ. The lawsuit was filed Monday in Polk County District Court in Iowa by Patrick Albanese, a magician and a hand model, who claims that the injury has affected his work.
"He’s a very accomplished musician and as part of his work, he does various slight-of-hand tricks," said Albanese’s attorney, Guy Cook.
In the lawsuit, Albanese said he was moving the lounge chair on a deck when the front legs collapsed, crushing his right index finger between the chair legs and a bar that was located on the base of the chair.
The lawsuit claims that Kmart and Martha Stewart Living should have issued a warning that the chair was defective, and failed to properly inspect the chair. Albanese is seeking compensation for medical expenses, physical and mental pain, and permanent partial disfigurement.
"This never should have happened and could have been prevented," Cook stated. Representatives for Kmart have not commented.
